WHEREAS, on June 26, 2000, James Spearman and Charlene Tate, both single persons executed a certain deed of trust to Dennis P. Schwartz, Trustee for the benefit of Fairway Independent Mortgage Corp. which deed of trust is of record in the office of the Chancery Clerk of DeSoto County, State of Mississippi in Book 1225 at Page 0380; and

WHEREAS, MidFirst Bank has heretofore substituted Shapiro & Brown, LLC as Trustee by instrument dated January 24, 2019 and recorded in the aforesaid Chancery Clerk's Office in Book 4670 at Page 196; and

WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, MidFirst Bank, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.

NOW, THEREFORE, I, Shapiro & Brown, LLC, Substituted Trustee in said deed of trust, will on March 14, 2019 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the East Front Door of the County Courthouse of DeSoto County, located at 2535 Highway 51 South, Hernando, MS 38632, to the highest and best bidder for cash or certified funds the following described property situated in DeSoto County, State of Mississippi, to-wit:

BEGINNING at a point located on the South line of Section 13, Township 2 South, Range 9 West, DeSoto County, Mississippi, and 2023.93 feet East of the Southwest Corner of said Section, point being in Star Landing Road and the Point of Beginning. Thence North 5 degrees 01 minutes 46 seconds East 599.9 feet to a point; thence South 84 degrees 53 minutes 03 seconds East 372.76 feet to a point; thence South 5 degrees 15 minutes 43 seconds West 599.9 feet to a point on the South line of Section 13 and located in Star Landing Road. Thence North 84 degrees 53 minutes 04 seconds West 370.32 feet along said Section line and road to the Point of Beginning. Containing 5.1 acres. There is a 50 foot right-of-way across the East side of this tract.

For indexing purposes: this property is located in the Southwest Quarter of Section 13, Township 2 South, Range 9 West, DeSoto County, Mississippi.

I WILL CONVEY only such title as vested in me as Substituted Trustee.
